العقود مش بتشيخ.

فيه فكرة غريبة شغالة في السوق: إن العقد لما يعدي عليه زمن، أو الأرض اللي جواه يغلى تمنها، بيبقى ممكن نتجاهله ونبني فوقه. لأ. العقد اللي اتمضى صح بيفضل عقد، مهما عدت السنين ومهما اتغير السوق. والقانون المصري بيقولها من غير لف: العقد شريعة المتعاقدين… مش شريعة الطرف اللي بقى أقوى.

١٨ نوفمبر ١٩٨٧… يوم الإمضا

يوم ١٨ نوفمبر ١٩٨٧، آباؤنا مضوا مع الدولة المصرية عقد شراء أرض باغوش عند الكيلو ٤٨… عقد موقّع من وزير السياحة شخصيًا. مش عقد عرفي، ولا ورقة اتكتبت على ركبة: عقد دولة بختمها، اتعمدت رسوماته الهندسية سنة ١٩٨٨، واتنشر قرار تقسيمه رقم ٨٤ لسنة ١٩٩٢ في الوقائع المصرية، واتفتحت القرية في سبتمبر من نفس السنة.

دفعوا فيه وقتها تحويشة عمرهم، وبنوا فوقه قرية كاملة، وسابوها لولادهم، وولادهم سابوها لولادهم. أربعين سنة تقريبًا من يوم الإمضا… ولا يوم واحد كانت الأرض دي من غير أصحابها.

العقد لسه في إيدينا

العقد ده لسه في إيدينا. الورق مصفرّ من الزمن، بس الختم واضح والتوقيع واضح، ومعاه جداول الإحداثيات اللي بتحدد الأرض بالمتر. وكله منشور على الموقع، صفحة صفحة، لأي حد عايز يقرا بعينه.

ونفس الأرض النهارده… باسم هاسيندا رأس الحكمة

والنهارده، نفس الأرض دي بتتسوّق ضمن مشروع «هاسيندا رأس الحكمة»… كأن بيوتنا نفسها مش موجودة، وكأننا إحنا مش مرئيين لحد.

فبنحط السؤال ده قدام كل واحد بيقرا، وقدام كل مستثمر بيفكر يحط فلوسه في مصر: هل توقيع وزير مصري على عقد بيع له تاريخ صلاحية؟ لو الإجابة أيوه، يبقى مفيش عقد في البلد دي ينفع يتوثق بيه حق. ولو الإجابة لأ، يبقى عقدنا قايم بكل اللي فيه… وكل تصرف في الأرض دي من غير رضا كل أصحابها باطل.

والقاعدة دي مش شغالة لصالحنا إحنا بس. نفس المبدأ اللي بيحمي عقدنا القديم هو اللي بيحمي عقد أي شركة كبيرة مضته مع الدولة النهارده الصبح. اللي يدوس القاعدة علشان صفقة واحدة تعدي، بيكسر الضمانة اللي كل صفقاته الجاية واقفة عليها هو شخصيًا. علشان كده الدفاع عن عقد ١٩٨٧ هو في حقيقته دفاع عن كل عقد لسه هيتمضي في مصر.

إحنا أهالي قرية ديزني بيتش وباغوش… ملاك مصريين من مختلف الفئات والطوايف، مصريين أبًا عن جد. إحنا ملاك على الشيوع بعقد بيع رسمي من الدولة، طبقًا لقانون الاستثمار ٤٣ لسنة ١٩٧٤ وتحت مظلة الهيئة العامة للاستثمار… والسجل التجاري رقم ٢٤٣٩٤٩ بيثبت كل ده. والقضية رقم ٥٧٤٨٠ قدام مجلس الدولة… وواثقين في القضاء المصري.

Contracts do not expire with age.

There is a strange idea circulating in the market: that once enough time passes, or once the land inside a contract becomes valuable enough, the contract can simply be ignored and built over. No. A contract that was signed properly remains a contract, however many years pass and however hot the market gets. Egyptian law says it plainly: a contract is binding law between its parties. Not binding law between whichever party happens to be stronger today.

18 November 1987: the day of the signing

On 18 November 1987, our parents signed a purchase contract with the Egyptian state for Baghoush land at kilometre 48, signed personally by the Minister of Tourism. Not an informal paper, not a handshake deal: a state contract carrying the state's own seal. Its engineering drawings were approved in 1988, its subdivision decree No. 84 of 1992 was published in the Official Gazette, and the village opened that same September.

They paid their life savings for it, built an entire village on it, and passed it to their children, who are passing it to theirs. Nearly forty years since the signing, and not for a single day was this land without its owners.

The contract is still in our hands

That contract is still in our hands. The paper has yellowed, but the seal is clear, the signature is clear, and the coordinate tables inside it define the land to the metre. All of it is published on this site, page by page, for anyone who prefers reading to believing.

The same land today, marketed as Hacienda Ras El Hekma

Today, that same land is marketed inside "Hacienda Ras El Hekma" as if our very homes do not exist, as if we are invisible.

So we put this question to every reader, and to every investor thinking about putting money into Egypt: does an Egyptian minister's signature on a sale contract come with an expiry date? If the answer is yes, then no contract in this country can secure anything for anyone. If the answer is no, then our contract stands with everything in it, and any disposal of this land without the consent of all its owners is void.

This rule does not work for us alone. The same principle protecting our old contract protects every contract any major company signed with the state this very morning. Whoever tramples the rule so one deal can pass breaks the guarantee his own future deals stand on. Defending the 1987 contract is, in truth, defending every contract yet to be signed in Egypt.

We are the families of Disney Beach and Baghoush… Egyptian owners from every walk of life, Egyptians through and through. We are co-owners in common under an official state sale contract, under Investment Law 43 of 1974 and Egypt's General Authority for Investment. Commercial Register No. 243949 proves it. Case No. 57480 is before Egypt's State Council, and we trust Egypt's judiciary.
